The Barista Shop
1. Applicability and scope
These terms and conditions apply to all personalized products offered by De Barista Shop to private customers (B2C) .
Personalized products include, but are not limited to:
- mugs (ceramic white, enamelled, ceramic with coloured handle and/or interior);
- clothing (hoodies, sweaters);
- accessories (such as tote bags);
- other personalized items offered now or in the future by The Barista Shop.
These terms and conditions apply exclusively to private purchases and do not apply to business orders.
2. Design, proof and approval
- For all personalized products the customer always receives a proof .
- Production will only start after explicit approval of the final proof by the customer.
- Once approved, the order is final and no further changes can be made.
3. Responsibility for content
- The customer is fully responsible for the content of the personalized design, including:
- spelling, names, dates and texts;
- supplied images and associated (author's) rights.
- The Barista Shop adopts the content provided or approved unchanged and does not make any substantive corrections unless this has been explicitly requested and approved by the customer .
- After approval of the final proof, full responsibility lies with the customer.
4. Right of withdrawal and cancellation
- Personalized products are custom-made and are therefore excluded from the right of withdrawal after approval of the final proof.
- Cancellation is only possible before approval of the final proof.
- After approval of the final proof, the following applies:
- no cancellation;
- no refund;
- no returns.
- Deviations from this are only possible in the event of demonstrable production errors .
5. Production errors
Production errors are exclusively understood to mean:
- obvious printing errors that deviate from the approved proof;
- skewed placement of the design;
- extreme color deviations compared to the proof;
- delivery of an incorrect product or incorrect product type.
The following are not considered production defects:
- errors that were already present in the proof;
- slight color deviations due to screen display;
- normal wear and tear through use.
6. Complaints, reporting period and handling
- Defects or damage must be reported within 5 days of receipt .
Reports submitted later will no longer be processed. - When reporting a case , mandatory photos must be submitted of:
- the outer packaging , including visible shipping label (overview photo);
- the inner packaging , including insulation and padding material;
- the damage to the product (detail and overview photo, including position in the packaging).
- If the notification is timely and complete, De Barista Shop will ensure free reprinting/replacement .
- Refunds will only be made if reprinting or replacement is not possible .
- Reports after 5 days will void the right to reprint or full reimbursement.
7. Delivery times and production
- Production starts after approval of the final proof and receipt of payment .
- The average production time is 4β6 business days .
- After production, the order will be offered for shipment .
- The average delivery time within the Netherlands is a maximum of 2 working days .
- All stated terms are indicative and constitute an obligation of best efforts.
- Deviations may occur in:
- peak period;
- public holidays;
- force majeur;
- carrier delays.
- Seasonal closure (example):
Production may be temporarily closed around Christmas, for example, from 12:00 noon on December 24th to January 4th . Orders will resume processing on January 5th .
8. Prices, payment and shipping costs
- All prices include VAT and exclude shipping costs , unless otherwise stated.
- Shipping costs (Netherlands):
- β¬4.95 for orders up to β¬30.00;
- free shipping on orders over β¬30.00.
- Payment takes place entirely in advance via the checkout of De Barista Shop.
9. Ownership and retention period of design
- The product remains the property of De Barista Shop until full payment has been received.
- After full payment, ownership passes to the customer.
- The approved design/file will be kept for a maximum of 1 year .
- If no communication is received, De Barista Shop is entitled to delete the design/file after this period.
10. Use, warranty and liability
- Normal wear and tear from use (such as washing, dishwasher, microwave or daily use) is not covered by the warranty or return policy.
- The warranty only applies to manufacturing or production errors , provided they are reported promptly.
- The Barista Shop is not liable for damage caused by incorrect or improper use .
- Liability for indirect damage (consequential damage) is excluded, including:
- lost revenue;
- emotional damage;
- consequential damage due to delayed delivery;
- damage to other products or property.
- If De Barista Shop is nevertheless liable, this liability is always limited to the purchase price paid by the consumer, including shipping costs , for the product in question.
11. Applicable law and disputes
- These terms and conditions and all agreements are exclusively governed by Dutch law .
- Disputes are preferably resolved by mutual agreement .
- If this fails, the dispute will be submitted to the competent court in the Netherlands .
- Consumers can also submit a dispute to a recognised dispute committee or via the European Commission's ODR platform .
